p.m. \nEver since the Supreme Court’s 2015 decision in Kingsley v. Hendrickson\, the legal landscape for pretrial detainee death or injury liability has changed\, and evolved.  The truth is:  if your agency operates a jail\, detention cell\, or other holding facility\, you will detain persons representing all segments of society – from hardened felons to professionals with no criminal history at all.   Pretrial detainees may also include community members with a variety of needs related to mental health and developmental issues\, or physical disabilities.  Understanding the current standards for imposing liability\, and how to avoid lawsuits\, is crucial for all agencies that operate any facility where suspects are held – even temporary holds awaiting transport to more established county or state facilities. \nAMRRP encourages attendance at this presentation for all Police Chiefs\, Command personnel\, and Training Supervisors responsible for instructing or implementing policies\, procedures\, and practices related to city/town jails\, detention cells\, or holding cells or like-enclosures.  Course content is approved by AZPOST for credit for sworn attendees. \nThis presentation is aimed at preparing Chiefs\, command staff and training officers to provide instruction to their sworn personnel on issues\, including: \n\nLegal and policy implications and principles in dealing with persons held in city/town jails\, detention cells or holding cells;\nUnderstanding how Title II of the ADA applies to law enforcement activities related to temporary custody of suspects;\nRecent judicial decisions and case law dealing with pretrial detainee death\, injury\, and medical issues;\nTips on how to train and instruct personnel to maximize detainee safety and avoid liability for pretrial detainee deaths or injuries.\n\nSpeakers: \n \nJim Jellison will present and hold a post-lunch question and answer session on this topic.  Jim is the managing attorney for Jellison Law Offices\, PLLC\, providing police legal advice\, and training and litigation services in the areas of law enforcement liability\, constitutional law and general government liability. HR Sentry is available to all AMRRP Members\, free of cost. \nWe are attaching below a brief summary of Prop 207\, in order to give some basic information between now and the Webinar. \n\nOn November 3\, 2020\, voters approved Proposition 207\, also known as the “Smart and Safe Arizona Act\,” which was effective on November 30\, 2020. The law legalizes the possession and consumption of recreational marijuana by allowing adults 21 years of age or older to use\, possess\, or transfer up to one ounce of marijuana and cultivate for personal use not more than six marijuana plants at a primary residence.\nProp 207 does not restrict the rights of employers to maintain a drug-and-alcohol workplace\, to have workplace policies that restrict marijuana use by employees or prospective employees\, or to otherwise prohibit or regulate conduct allowed by Prop 207 when such conduct is on or in the employer’s property.\nProp 207 does not limit any privilege or right of a qualifying patient or designated caregiver under the Arizona Medical Marijuana Act (AMMA) and those provisions remain in effect. While AMMA provides that a qualifying patient or designated caregiver cannot be discriminated against based on certain conditions\, Prop 207 does not grant employment protections to recreational marijuana users. Therefore\, existing workplace policies that prohibit drugs or alcohol likely do not require changes in light of Prop 207. Updates are only necessary if an employer seeks to allow marijuana use or possession on the employer’s property.\n\nSpeakers \nChristina Estes-Werther is Of Counsel at Pierce Coleman PLLC.
