He recently retired as an Assistant Fire Chief and Attorney on the Command Staff at a Phoenix area Fire Department.  Mr. Robens is a Partner in the law firm of Jellison & Robens\, PLLC.  The Firm provides Police Department legal advice\, training\, and litigation services in the areas of law enforcement liability\, constitutional law\, and general governmental liability. The Firm routinely litigates cases in the federal courts handling a variety of constitutional cases in defense of governmental entities\, their agencies\, and departments. He frequently consults with and lectures nationally to public safety agencies\, conferences\, and conventions. There were an estimated 100\,306 fatal overdoses over the 12 months through April 2021 — the most ever reported in a 12-month period and double the annual number of car accidents and firearm deaths combined. \nThis has serious implications for all AMRRP members in general as well as law enforcement and first responders in particular. \nPlease join us for our first AMRRP Roundtable of 2022!  We are most fortunate to have Robert DeVries as our speaker!  Robert recently retired as Police Chief of the City of Kingman\, and not only is Robert well versed on this topic\, he gives a great presentation! \nPlease join us for this important topic.

DESCRIPTION:DIFFICULT ISSUES FACING LAW ENFORCEMENT:  \nDEALING WITH THE MENTALLY AND PHYSICALLY DISABLED AND COGNITIVE AND DEVELOPMENTALLY CHALLENGED AND THE ROLE OF TITLE II OF THE AMERICANS WITH DISABILITIES ACT IN LAW ENFORCEMENT ACTIVITIES \nLaw enforcement is faced with ever-increasing and complex challenges involving community members with a variety of needs related to mental health\, cognitive and/or developmental issues\, and physical disabilities.  These situations are also prone to gain the attention of media on the local\, state\, and even national level\, and are of increasing concern for communities throughout our nation.  AMRRP encourages attendance at this presentation which will focus on the legal and policy aspects of law enforcement interaction with persons fitting these diverse categories. \nThis presentation is aimed at preparing command staff and training officers to provide instruction to their sworn personnel on issues\, including: \n\nLegal and policy implications in dealing with persons suffering from mental illness or challenged by cognitive or developmental disabilities;\nHow issues involving these segments of the population result in litigation\, and what a typical lawsuit in this area looks like;\nUnderstanding how Title II of the ADA applies to law enforcement activities and how the courts assess law enforcement liability under the ADA.\n\nCourse content is approved by AZPOST for credit for sworn attendees. \nPRESENTED BY: \n\nJim Jellison.  Managing attorney for Jellison Law Offices providing police legal advice\, and training and litigation services in the areas of law enforcement liability\, constitutional law and general government liability. DESCRIPTION:THE CHANGING LANDSCAPE FOR LIABILITY RELATED TO PRETRIAL DETAINEES  \nWHAT POLICE AGENCIES NEED TO KNOW ABOUT THE CURRENT STATE OF THE LAW \nHOW TO AVOID LAWSUITS ARISING FROM PRETRIAL DETAINEE DEATH OR INJURY \nPresentation from 10:00- noon \nFollow up Q&A at 1:30 p.m. \nEver since the Supreme Court’s 2015 decision in Kingsley v. Hendrickson\, the legal landscape for pretrial detainee death or injury liability has changed\, and evolved.  The truth is:  if your agency operates a jail\, detention cell\, or other holding facility\, you will detain persons representing all segments of society – from hardened felons to professionals with no criminal history at all.   Pretrial detainees may also include community members with a variety of needs related to mental health and developmental issues\, or physical disabilities.  Understanding the current standards for imposing liability\, and how to avoid lawsuits\, is crucial for all agencies that operate any facility where suspects are held – even temporary holds awaiting transport to more established county or state facilities. \nAMRRP encourages attendance at this presentation for all Police Chiefs\, Command personnel\, and Training Supervisors responsible for instructing or implementing policies\, procedures\, and practices related to city/town jails\, detention cells\, or holding cells or like-enclosures.  Course content is approved by AZPOST for credit for sworn attendees. \nThis presentation is aimed at preparing Chiefs\, command staff and training officers to provide instruction to their sworn personnel on issues\, including: \n\nLegal and policy implications and principles in dealing with persons held in city/town jails\, detention cells or holding cells;\nUnderstanding how Title II of the ADA applies to law enforcement activities related to temporary custody of suspects;\nRecent judicial decisions and case law dealing with pretrial detainee death\, injury\, and medical issues;\nTips on how to train and instruct personnel to maximize detainee safety and avoid liability for pretrial detainee deaths or injuries.\n\nSpeakers: \n \nJim Jellison will present and hold a post-lunch question and answer session on this topic.  Jim is the managing attorney for Jellison Law Offices\, PLLC\, providing police legal advice\, and training and litigation services in the areas of law enforcement liability\, constitutional law and general government liability.
