DESCRIPTION:THE CHANGING LANDSCAPE FOR LIABILITY RELATED TO PRETRIAL DETAINEES  \nWHAT POLICE AGENCIES NEED TO KNOW ABOUT THE CURRENT STATE OF THE LAW \nHOW TO AVOID LAWSUITS ARISING FROM PRETRIAL DETAINEE DEATH OR INJURY \nPresentation from 10:00- noon \nFollow up Q&A at 1:30 p.m. \nEver since the Supreme Court’s 2015 decision in Kingsley v. Hendrickson\, the legal landscape for pretrial detainee death or injury liability has changed\, and evolved.  The truth is:  if your agency operates a jail\, detention cell\, or other holding facility\, you will detain persons representing all segments of society – from hardened felons to professionals with no criminal history at all.   Pretrial detainees may also include community members with a variety of needs related to mental health and developmental issues\, or physical disabilities.  Understanding the current standards for imposing liability\, and how to avoid lawsuits\, is crucial for all agencies that operate any facility where suspects are held – even temporary holds awaiting transport to more established county or state facilities. \nAMRRP encourages attendance at this presentation for all Police Chiefs\, Command personnel\, and Training Supervisors responsible for instructing or implementing policies\, procedures\, and practices related to city/town jails\, detention cells\, or holding cells or like-enclosures.  Course content is approved by AZPOST for credit for sworn attendees. \nThis presentation is aimed at preparing Chiefs\, command staff and training officers to provide instruction to their sworn personnel on issues\, including: \n\nLegal and policy implications and principles in dealing with persons held in city/town jails\, detention cells or holding cells;\nUnderstanding how Title II of the ADA applies to law enforcement activities related to temporary custody of suspects;\nRecent judicial decisions and case law dealing with pretrial detainee death\, injury\, and medical issues;\nTips on how to train and instruct personnel to maximize detainee safety and avoid liability for pretrial detainee deaths or injuries.\n\nSpeakers: \n \nJim Jellison will present and hold a post-lunch question and answer session on this topic.  Jim is the managing attorney for Jellison Law Offices\, PLLC\, providing police legal advice\, and training and litigation services in the areas of law enforcement liability\, constitutional law and general government liability. Routinely litigating cases in the federal courts\, Jim has experience handling jail cases and ADA-based discrimination and retaliation issues – at trial and on appeal – against governmental entities\, their agencies\, and departments. \nCommander (ret) Sean Stewart will co-present. \n
